1.1 For the purposes of these Terms and Conditions, these terms have the following defined meaning: "Customer" means a person who has valid Registration with the Website; "L&T" means Lime & Tonic Sydney Pty Ltd ABN 72 146 927 620; "Offers" means any offers, Offers, promotions, goods or services (including both Purchases and Freebies) provided or otherwise available on the Website; “Freebie” means free giveaways offered by Merchants that are available for download from the Website at no cost; "Merchant" means a third party seller of goods or provider of services for which a Voucher can be purchased by a Customer through the Website in accordance with these Terms and Conditions; "Purchase" means a purchase by a Customer of a Voucher under an Offer in accordance with these Terms and Conditions; "Registration" means the process of creating a valid user account with the Website in accordance with these Terms and Conditions; "Voucher" means a voucher issued by a Merchant which, when duly purchased by a Customer through the Website, entitles a Customer, subject to these Terms and Condition, to redeem that Voucher at the respective Merchant solely in exchange for the specific goods and/or services to which that voucher relates; "Website" means the website https://www.limeandtonic.com.au/ operated by L&T; “You” includes individuals, companies, or other entities) who access this Website.
2.1 The Website operated by L&T represents a marketing platform on which various discounted or other special Offers ("Offers") are advertised, communicated and offered by the Merchants for Purchase solely by Customers.
2.2 You acknowledge and agree that for certain Offers, the Merchant requires a minimum number of Customers to purchase that Offer, within the specified time period, in order for that discounted rate to be valid and for the Vouchers to be honoured (“Valid”). Accordingly, an Offer is only Valid if a minimum number of Vouchers are actually purchased for that Offer, within the time period specified on the Website, as determined by L&T. If the minimum number of specified Vouchers, as displayed on the Website, is not purchased in the stipulated time period, the Offer is automatically void, and no Customer is entitled to have their Voucher honored, or to obtain those goods or services, (or any other goods or services) from the Merchant. If an Offer is void because it does not meet the minimum number of Voucher sales, You will not have to pay for that Voucher, but You will not have any claim or other remedy against the Merchant or L&T.
2.3 You also acknowledge and agree L&T is only the operator of the Website. L&T only provides specific, limited facilitation services of an independent nature as specifically set out herein – that is, as a body who organises discounted goods and services for purchase from the Merchants. Any contractual relationship between the Customer and L&T is limited to the purchase of the Voucher. Any issues relating to the goods and services to which that Voucher relates is solely between the Customer and the relevant Merchant.
3.1 Customer(s) must have a valid Registration in order to be eligible for any Purchase or Freebie download.
3.2 For a Registration to be valid, a user must provide true, complete and valid details, including full name, date of birth, email address, phone number, and postal address, in the relevant electronic registration form(s) available on the Website. A Registration is only valid and effective if that user: (i) has full legal capacity to enter into such an agreement; (ii) verifies that all the details they have provided in the Registration process are valid, true, complete and not misleading; and (iii) Expressly agrees that their personal information may be used, and disclosed in accordance with clause 10 below.
3.3 Once the Registration process has been properly completed, the user will: (i) Receive a confirmation email, confirming that that their Registration has been successful and that they are now a Customer; and (ii) be allocated a password and a user account via the email address they have supplied. Upon receipt, the Customer agrees to keep the password and account details strictly confidential and immediately notify L&T in the event of any actual or suspected loss, unauthorised use, and other breach of their account or the security of the Website. Customer expressly acknowledges and agrees that they will be liable for any damage, loss or other harm suffered by L&T, the Merchants, other Customers, or other third parties, as a result of unauthorised use of their account (including where they have not taken reasonable steps to protect their account details or alert L&T about any possible breach), or any unauthorised act or breach of the Website. Customer shall be obliged to promptly modify/change/amend (solely through accessing the Customer’s account with the Website) their respective account details if L&T so requires. L&T may independently require Customers from time to time to re-validate their accounts and their registered details.
3.4 Each person may only have one active Customer account with the Website.
3.5 L&T reserves the right to decline any Registration, or to cancel any Customer account (with immediate effect), at any time, in its sole discretion, including: (i) In the event of any breach of any obligations in these Terms and Conditions; (ii) The Customer does any act, or thing, (including during the Registration process), with the intent of, or which actual does actually does, misrepresent their true identity, provide any false, misleading or incomplete information, or seek to obtain any benefit through fraud, deception, or by committing any criminal offence (as determined by L&T in its absolute discretion).Next
